By accessing or using eScanX ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

eScanX provides document processing and optical character recognition (OCR) services through our API and web interface. We offer various subscription tiers with different usage limits and features.

To use our Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4.1 Subscription Plans

We offer Free, Starter, Professional, and Enterprise plans with varying limits on document processing and API calls.

4.2 Payment Terms

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• Prices are subject to change with 30 days notice
• Failed payments may result in service suspension

4.3 Free Trial

Free tier users receive limited access to the Service. We reserve the right to modify or discontinue free tier offerings at any time.

You agree not to:

• Exceed your plan's usage limits without upgrading
• Share your API keys with third parties
• Use the Service for illegal or fraudulent purposes
• Upload malicious content or malware
• Attempt to bypass rate limiting or security measures
• Reverse engineer or copy our technology
• Resell or redistribute our services without permission

6.1 Your Content

You retain ownership of all documents you upload. By using the Service, you grant us a limited license to process your documents solely for the purpose of providing the Service.

6.2 Our Technology

eScanX and its underlying technology, including our API, software, and documentation, are protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

Our processing of your personal data is governed by our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided by you is accurate.

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for:

• Service downtime or maintenance
• Third-party service failures (AWS, Stripe, etc.)
• Internet connectivity issues
• Force majeure events

Enterprise customers may negotiate separate Service Level Agreements (SLAs).

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
• WE DO NOT GUARANTEE OCR ACCURACY OR FITNESS FOR PARTICULAR PURPOSES

You agree to indemnify and hold harmless eScanX from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you upload to the Service

11.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees when due
• Engage in fraudulent or abusive behavior

We will provide reasonable notice except in cases of serious violations.

If you use our API:

• You must comply with rate limits for your subscription tier
• API keys are confidential and non-transferable
• We may modify API endpoints with reasonable notice
• You must implement proper error handling
• We reserve the right to revoke API access for violations

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

14.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

14.2 Arbitration

• Entire Agreement: These Terms constitute the entire agreement between you and eScanX

• No Waiver: Failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms without our consent
